Federal & State Protections Against Workplace Discrimination

The EEOC enforces federal laws that prohibit discrimination based on race, color, religion, sex, national origin, age, disability, and genetic information.

Massachusetts employees are protected from workplace discrimination under state law, including Chapter 151B, the Massachusetts Fair Employment Practices Act. These protections can extend to workers at smaller employers than federal laws, such as Title VII, which generally applies to businesses with 15 or more employees. Chapter 151B generally applies to employers with six or more workers.

Massachusetts law also addresses discrimination based on pregnancy, parental status, sexual orientation, gender identity, military status, and genetic information. Employees may also have protections against harassment and retaliation. These laws provide important safeguards for workers across North Reading.

Examples of Discrimination in the Workplace

Workplace discrimination can take many forms, and some conduct may be less obvious than others

Examples of discrimination may include:

  • Unequal treatment: Being denied a promotion, fired, paid less, or treated differently because of a protected characteristic.
  • Workplace harassment: Facing offensive or abusive conduct from a manager, coworker, or other workplace individual because of a protected characteristic.
  • Denied accommodations: Being refused a reasonable accommodation for a disability or sincerely held religious belief.

These are only a few examples of potential workplace discrimination. If you or a loved one has experienced discrimination at work, our EEOC lawyer in North Reading can help you understand your rights, evaluate your options, and determine what steps may be appropriate for your situation.

Filing Deadlines & the EEOC Process in Massachusetts

In Massachusetts, the deadline to file an EEOC charge of discrimination is 300 days from the date of the discriminatory act. This extended window applies because Massachusetts law also prohibits the same conduct, triggering a work-sharing agreement between the EEOC and the MCAD.

Understanding how the process unfolds helps you prepare:

  • Agency investigation: After a charge is filed, the relevant agency may request documents, interview witnesses, and review company policies.
  • Mediation and conciliation: The EEOC may offer mediation before the investigation concludes. If the agency finds reasonable cause, it may attempt conciliation between the parties.
  • Notice of right to sue: If conciliation fails or the EEOC closes the charge, you receive a Notice of Right to Sue. A federal lawsuit must generally be filed within 90 days of receiving that notice.
  • MCAD right-to-sue letter: For a state-level complaint, you can request a right-to-sue letter after the complaint has been pending for 90 days. A state-law discrimination lawsuit must generally be filed within three years of the discriminatory act under M.G.L. c. 151B, Section 9.
